As of December 1991, the Patient Self-Determination Act mandated that health care institutions which receive funding from Medicare or Medicaid provide written information about persons rights to participate in medical decision-making and formulate advance directives. The PSDA required each state…acting through a State agency, association, or other private nonprofit entity develop a written description of the law of the State concerning advance directives that would be distributed by providers or organizations under the requirements of [the Act].

This chapter presents two models of priming. The primary task under consideration is the identification of words presented visually at threshold. The first model, REMI, is a model for long-term priming in implicit memory. It explains repetition priming effects by assuming that during study of a word some contextual information is added to the corresponding lexical trace. This contextual information stored during the study task will tend to match the contextual information present during the test task, leading subjects to prefer (...) studied words over non-studied words. The second model, ROUSE, is a model of short-term priming. ROUSE stands for Responding Optimally with Unknown Sources of Evidence, and it is able to explain an intricate pattern of results. (shrink)

Thomas More's History of Richard III is a metahistory, rich in factual and fictional details. I will discuss More's concept of historiography as a rhetorical art and how his presentation of history transformed details of what was imperfectly known about Richard III into a polemic about what should be believed as an irrefutable truth. More's conception of history is much more amorphous than modern theories. He incorporated classical myths, literature, history, and philosophy along with phantasies, dreams, and oral testimonies to (...) recreate his historical Richard III as a tragic figure. More saw patterns of immoral behavior deeply rooted in the histories of the Plantagenet kings from the twelfth century to 1485 as if the sins of the fathers are repeated by their children. More used his sources, the antiquarian John Rous, the historian Polydore Vergil, and the oral history of Archbishop/cardinal John Morton to prove that the immorality of the Plantagenets, embodied in Richard III, was a curse that will be purged from England by the ascendance of Henry VII. William Shakespeare copied and embellished More's tragic vision of Richard III. Their historical facts and fictions enhanced their moral signification of the rise and fall of Richard III in English history. (shrink)

The Venerable John Henry Cardinal Newman seemingly had the “Midas touch” in reverse. Oxford, Littlemore, Dublin were all sites of failures; the “Achilli Affair” was a humiliation; the quarrel with Faber was an embarrassment. Nonetheless, most people today think of Newman as a rousing success story. Why? Newman serves as an object lesson in living the Paschal Mystery, whereby each moment of crisis can be transformed into a moment of grace.

In his discussion of the tragic act in Poet. 14. 1453b15 ff. Aristotle separates the pity which we feel at mere suffering from pity roused by the way in which this suffering is or will be brought about. The revenge of an enemy is not in itself pitiable. We pity, if victim and agent are closely related to one another as members of the same family, but only if the action is of a certain kind. Four possible ways of presenting (...) the tragic act are therefore distinguished: attempted but not performed, with knowledge of the relevant facts ; performed with knowledge ; performed but in ignorance, recognition following later ; attempted in ignorance but not performed, since recognition occurs in time to prevent it. Of these four variations the first is censured on the ground that it is morally shocking without being tragic, since it lacks πάθος. The second is mentioned in b27 as the favourite of the older poets, but is here passed over without comment. The third is explicitly approved on the ground that it avoids moral shock and has the emotional κπληξις of the recognition. But for some reason which he does not state, Aristotle prefers the last, where recognition is in time to prevent the tragic suffering from actually taking place. (shrink)

The civil war which ended in the victory of Octavian and the suicide of Antony and Cleopatra is one of the most exciting but most obscure periods of Roman history, obscure mainly because the victor succeeded in imposing bis version of affairs upon his countrymen and through them on posterity. That is not to say that his version is necessarily completely false: the danger that threatened Rome was a real one, the national feeling that resulted in the coniuratio totius Italiae (...) of 32 B.C. and that inspired Virgil and Horace later was not an artificial growth, though it was carefully tended. But in kindling the requisite war-feeling and in rousing the necessary enthusiasm both sides had to propagand for themselves, and in ancient times propaganda often became a matter of personal abuse and mud-slinging. In this Octavian's agents were perhaps more successful, though few nowadays would accept the conventional portraits of Antony and Cleopatra as anywhere near the truth. But Antony's propaganda, though not so effective, was not obliterated by Octavian's victory; indeed a great deal of it is still preserved and masquerades as fact in histories of the period, where Octavian's personal character suffers badly. The thesis of this book is that moral evil is for Kant an ineradicable aspect of human existence; moreover the author argues that moral evil is a datum of experience which none of the rationalist systems which preceded Kant's, nor Hegel's system which came after, could assimilate, a rock upon which they all shattered. Reboul's concern is to investigate the "insondable profondeur du mal radical" as this theme appears in the forty years of Kant's active philosophic production; his interest reflects (...) the influence of his mentor, Karl Barth. Reboul is at his best in his clear depiction of Kant's ingenuity at reconciling the optimism of the Enlightenment with the Reformation's conviction of sin. For example, the very insufficiency of Leibniz' attempt to supply a ground for every decision of the will, his inability to explain the reality of willful evil, is used by Kant as an excuse for not going beyond Leibniz' theory. "Expliquer la liberté serait la détruire," writes Reboul. Kant assimilates the idea of progress by assigning it to the level of phenomenal or technical improvements. Moral value resides only in those acts by which we loosen the ties of sensible determination upon the will and render ourselves autonomous. The struggle for autonomy must be fought by each man for himself; there is a decisive limit to the help we can derive from "progress." For Kant man is bent towards evil not only by reason of his spontaneous attraction to sensible objects, but also in virtue of a basic perversion of his faculty of judgment, a perversion which comes close to being identified with liberty itself. It is significant, as Reboul notes, that all of Kant's examples of free will are also examples of moral evil. This low estimate of man's spontaneous faculties is at the basis of Kant's suspicion of all eudaimonistic ethics, his demand that every moral decision be "disinterested," that the moral law be the sole determinant of the will. Just as in the first Critique Kant insists on finding an adequate cause to ground the universality which attaches to the laws of science and mathematics, so in ethics he demands an adequate explanation of the radical character of evil present in the world; this he finds in a perversion of the human faculty of judgment, whereby a contingent element of experience is illegitimately raised to the status of a universal maxim by the will. The moral decision must be disinterested because every attraction by a sensible object threatens to become the occasion for such a definitive fixation of our moral character. But Kant's deeper originality lies in a view which bridges the Enlightenment and later periods. Kant breaks with a convention of systematic philosophical activity which had held sway from the Greeks through Leibniz, the view that reality must be consistent. For Kant, the principle of non-contradiction does not apply to the phenomenal world but only to the noumenal. For Kant, human existence can harbor contradictions; consequently man lives perpetually in tension. As a citizen of two worlds, he is committed to achieving a moral ideal which the basic perversion of his will renders unrealizable. This tension can be viewed optimistically, as with Hegel ; then the "positivity" of evil is interpreted as a necessary step, a " felix culpa," by which God rouses man to greater efforts and brings him to maturity, autonomy, and a vision of the real. The other alternative is the Schopenhauerian interpretation, wherein the tensions in the absurdity of the human condition are taken as too extreme to warrant further participation. Reboul is excellent in showing the form these tensions take in Kant's system: the mystery of how a basically perverted will can be converted into a "good faith," although this is the ethical command; the command never to feel oneself "justified" through having done one's duty, even though the moral command obligates us to strive perpetually for this condition. However, in stressing the harsh import of sin for Kant, and thus saving Kant from Hegel, has Reboul not placed Kant in the company of Schopenhauer, Sartre, and Camus?--P. M. (shrink)

Peter Weir's film Gallipoli is a chronicle of the disastrous Dardanelles campaign of the first World War, but it is also a film about racing. Archie is trained by his uncle Jack to run "as fast as a leopard." The film begins as it ends, with Archie sprinting in response to a whistle. Frank is first shown racing after a train, along with friends who are on their way to enlist. Archie and Frank meet while competing in a race, they race in Cairo once they have enlisted, and they finally race death. From the beginning, Archie has been faster; even at the end he is the first to die. And from the beginning he has swept Frank along in his wake, encouraging him, pushing him, inspiring him, and helping him to positions for which he is inadequately qualified. In the end, Archie's compassion and kindness prompt a decision which has grim consequences both for himself and for hundreds of others. But it isn't just the scope of the real human disaster, or the enormity of the blunder, or the pointlessness of the entire enterprise, or even my renewed conviction that stupidity is, in fact, evil, that is so unsettling. DNA double‐strand breaks (DSBs) are extremely hazardous lesions for all DNA‐bearing organisms and the mechanisms of DSB repair are highly conserved. In the eukaryotic mitotic cell cycle, DSBs are often present following DNA replication while, in meiosis, hundreds of DSBs are generated as a prelude to the reshuffling of the maternally and paternally derived genomes. In both cases, the DSBs are repaired by a process called homologous recombinational repair (HRR), which utilises an intact DNA molecule as the repair template. Mitotic (...) and meiotic HRR are managed by ‘checkpoints’ that inhibit cell division until DSB repair is complete. Here we attempt to summarise the substantial recent progress in understanding the checkpoint management of HRR in mitosis (focussing mainly on mammals) and then go on to use this information as a framework for understanding the presumed checkpoint management of HRR in mammalian meiosis. Two rotational bands have been identified and characterized in the proton-magic N = Z + 1 nucleus Ni-57. These bands complete the systematics of well-and superdeformed rotational bands in the light nickel isotopes starting from doubly magic Ni-56 to Ni-60. High-spin states in Ni-57 have been produced in the fusion-evaporation reaction Si-28(S-32, 2p1n)Ni-57 and studied with the gamma-ray detection array GAMMASPHERE operated in conjunction with detectors for evaporated light charged particles and neutrons. The features of the rotational bands in Ni-57 (...) are compared to those of neighbouring isotopes and interpreted by means of configuration-dependent cranked Nilsson-Strutinsky calculations. The two observed high-spin bands are considered signature partners and assigned to configurations with one 1g(9/2) proton and one 1g(9/2) neutron, resulting in an unambiguous understanding of the energetically favoured signature alpha = -1/2 band but a somewhat less satisfactory description of the signature alpha = +1/2 band. The vast majority of contributions to the literature on spirituality in nursing make extravagant claims about transcendence, eternity, the numinous, higher powers, higher levels of existence, invisible forces, cosmic unity, the essence of humanity, or other supernatural concepts. Typically, these assertions are made without the support of argument or evidence; and, as a consequence, alternative ways of theorizing ‘spirituality’ have been closed off, while the lack of consistent scholarship has turned the topic into a metaphysical backwater. In this paper, I (...) adopt a different premise, rejecting unsupported claims, and surveying the ‘spirituality’ terrain from a naturalistic and reductionist perspective. I argue that, if we rid ourselves of non‐naturalistic assumptions, we will discover theoretical and clinical resources in health psychology, social psychology, neuropsychology, and pharmacopsychology – resources which confirm that it is possible to conceptualize the study of existential concerns, and how health professionals might respond to them, in a properly scientific manner. In order to illustrate the potential usefulness of these resources, I will take palliative care as an example. (shrink)

Quantum mechanical measurements on a physical system are represented by observables - Hermitian operators on the state space of the observed system. It is an important question whether all observables may be realized, in principle, as measurements on a physical system. Dirac’s influential text ( [1], page 37) makes the following assertion on the question: The question now presents itself – Can every observable be measured? The answer theoretically is yes. In practice it may be very awkward, or perhaps even (...) beyond the ingenuity of the experimenter, to devise an apparatus which could measure some particular observable, but the theory always allows one to imagine that the measurement can be made. This paper investigates four questions related to ethical issues associated with the involvement of engineers and scientists in 'military work', including the influence of ethical values and beliefs, the role of gendered perspectives and moves beyond the purely technical. It fits strongly into a human (and planet)-centred systems perspective and extends my previous AI and Society papers on othering and narrative ethics, and ethics and social responsibility. It has two main contributions. The first involves an analysis of the literature through (...) the application of different ethical theories and the application of gendered analysis to discussion of masculinities in engineering and the military. The second is a survey of scientists and engineers to investigate their opinions and experiences. The conclusions draw together the results of these two contributions to provide preliminary responses to the four questions and include a series of recommendations covering education and training, ethical approval of work not involving human participants or animals, the need for organisational support, approaches covering wider perspectives and the encouragement of individual ethical commitment. Cognitive Stylistics or Poetics has emerged as a powerful framework for the analysis of literary works due to the fact that it provides us with tools stemming from bodily experience which aim at universality. This proposal attempts to shed additional light on the analysis of the characters and settings carried out by Freeman (1995) by making use of some recent developments within the framework of Cognitive Linguistics, especially in connection with metonymy and image-schemas. It lends further support to the thesis (...) that Cognitive Poetics is endowed with explanatory power since it accounts both for the processes of generation and understanding of literary texts. The notion of consent which rose to the forefront in biomedical ethics as an attempt to safeguard patients' autonomy, is relatively new. The notion itself requires qualification, for it precludes neither duress nor ignorance. More seriously, I argue here that consent is redundant except in situations where paternalism prevails. Paradoxically, these are the very situations where it may be difficult to uphold or to verify voluntary consent. I suggest that a request-based relationship has the potential to overcome these difficulties. It (...) enhances patients' participation in decision making, requires that the patients remain in command and avoids their subordination. Request is also more conducive to treatments that are representative of patients' own values and perceptions. In practice, what one wants and what one agrees to, often concur. But these are not conceptually identical issues, and they carry important differences of emphasis. (shrink)

This book provides a clear and nuanced appraisal of Hegel's treatment of Africa, India, and Islam, and of the implications of this treatment for postcolonial and global studies. Analyzing Hegel's master-slave dialectic and his views on Africa, India, and Islam, it situates these views not only within Hegel's historical scheme but also within a broader European philosophical context and the debates they have provoked within Hegel scholarship. Each chapter explores various in depth readings of Hegel by postcolonial critics, investigating both (...) the Eurocentric and potentially global nature of his dialectic. Ultimately, the book shows both where of this profoundly influential thinker archetypally embodies certain Eurocentric traits that have characterized modernity and how, ironically, he himself gives us the tools for working towards a more global vision. Offering a concise introduction not only to an important dimension of Hegel's thought - his orientation towards "empire" - but also to the various issues raised by postcolonial theory and global studies, this book will be of use to philosophers as well as advanced students of literary and cultural theory alike.
